“Notaries recognized by Mainland China” are China-appointed attesting officers (in Hong Kong).
In the system of attesting officers, legal documents held by Hong Kong residents must be attested by an attesting officer appointed by the Ministry of Justice, and must be sealed and forwarded by China Legal Service (HK) Ltd. before they can be used in the Mainland for legal matters.
As the differences between the legal systems of Hong Kong and Mainland China give rise to different legal basis, validity and procedures of notarial attestation, the system is adopted mainly to ensure the authenticity and validity of notarized documents issued in Hong Kong to be used in Mainland China.
The system of appointed attesting officers was implemented in 1981. For over 20 years, this system has enabled the use of notarized documents by and between the different social and legal systems of the Mainland and Hong Kong. It plays a significant role in regulating the market, preventing commercial frauds,and protecting the rights and interests of people in the Mainland and Hong Kong.
Chinese notarized documents
These refer to documents issued in Hong Kong to be used in Mainland China. Documents issued in Hong Kong must be notarized before they can be used in Mainland China. This means such documents must bear the signature and seal of a China-appointed attesting officer to be valid for use.
